Malathi Das practises primarily as a commercial litigation and family lawyer, frequently appearing before the Court of Appeal, High Court, State Courts and Family Justice Courts in Singapore. She regularly undertakes contentious matters involving cross-border commercial and personal law disputes, including in relation to employment, defamation, commercial, business and family disputes.

Malathi’s work covers arbitration and alternative dispute resolution proceedings, in which she has experience acting as Counsel in ICC and SIAC arbitration proceedings and other ADR work involving mediation and family arbitration. She has, in particular, been involved in family arbitration proceedings involving high-net worth and high-profile clients who appreciate the confidentiality that the arbitration offers them.

Malathi has a special interest and is leading light in family, custody, gender and child issues, on which she is frequently quoted by the local media. Her forte is in advising on and acting in family disputes which involve cross-cultural and cross-border marriages involving multiple proceedings, matrimonial asset division, custody disputes, as well as stay applications based on forum non conveniens.

With the internationalization of families in an increasingly globalized world, the need for a multi-dimensional approach that takes into account complex issues relating to the choice of forum or jurisdiction and effective enforceability of court orders, has been palpable in Malathi's work. For example, she often advises clients on the optimal choice of the country in which to commence proceedings, taking into account comparative financial, child custody and other settlements, costs, timescale and the ease of enforcing orders. Such choice of forum can have a significant impact on the practical consequences arising from a marriage dissolution or in other family circumstances.

Malathi's access to an active network of family practitioners worldwide, further places her in a prime position to advise on and assist with cross-jurisdictional family disputes, in a fast changing legal landscape both locally and internationally.

Malathi is an Associate Mediator and Family Mediator with the Singapore Mediation Centre and among the earliest of Child Representatives appointed by the Family Justice Courts. Her training and experience is these capacities enable her to offer holistic solutions to her clients by applying a variety of dispute resolution options.

She has also provided expert evidence on Singapore family law used in courts of jurisdictions such as Australia and the United Kingdom. Such opinions includes expert evidence given in the Federal Circuit Courts of Australia and the Family Court of Australia - see Hugh & Skinner [2012] Fam CA 145, as well as the High Court of Justice, Family Division in England and Wales - see K v B (rev 1) [2015] EWHC 2912. These include opinions on matters involving parental abduction of children governed by the Hague Convention, division of matrimonial assets including superannuation funds such as the Central Provident Fund, registering of mirror orders, both in respect of children as well as money orders.

Malathi also writes and speaks extensively and teaches at post-graduate level locally, and is a Senior Fellow and faculty lecturer in the Practice Training Course of the Singapore Institute of Legal Education.

Dominic Tan

Senior Legal Associate

Dominic Tan's practice area covers a range of corporate commercial work, including corporate investment and financing, M&A, intellectual property, employment and HR and regulatory compliance.

Dominic is an assuring hand to local and foreign clients in navigating the ropes of establishing and operating a business presence in Singapore, from ground zero up, including the registration of the desired legal vehicle, the procurement of immigration passes for foreign employees, the conclusion of leases for business and residential premises, and the determination of regulatory requirements.

Dominic regularly assists clients in investment and financing transactions involving all types of instruments and securities, including convertible bonds and notes, share charges, and personal and corporate guarantees. This work often involves cross-border elements, requiring him to work and collaborate with local counsel in various jurisdictions.

Complementing his corporate commercial work is Dominic's experience in handling employment and HR-related matters, including regulatory compliance, preparation of contracts, employee misconduct, transfer of employees in connection with the disposal, acquisition or reorganization of businesses and employee stock option plans.

Melvyn Loey

Legal Associate

Melvyn Loey's practice is dominated by a strong intellectual property and TMT focus, including copyright matters, telecommunications and IT transactions and a substantial volume of patent prosecution work, on which he provides advice on and manages effective filing and prosecution strategies in patent portfolios straddling countries across the globe.

Melvyn’s involvement in intellectual property preceded his association with the firm, having previously been a senior executive dealing with Legal Policy and International Affairs in the Intellectual Property Office of Singapore, where he was involved in administering the Copyright Act of Singapore with the mission of calibrating it within the realities and challenges of the digital age. He was also involved in work leading to changes in the jurisdiction of the Copyright Tribunal in Singapore.

Rachel Low

Rachel Low's practice focuses mainly on corporate and other regulatory compliance, including in the areas of personal data protection, supply of goods, securities, telecommunications and customs regulations, corporate due diligence as well as employment.

Rachel also assists in commercial transactions, in particular, those involving the licensing of intellectual property rights or the exploitation of technological innovations, including internet businesses, e-commerce and electronic services.

With her interest in international relations, Rachel appreciates the cross-border interactions that her current practice affords her, on a regular basis - an interest that had its early beginnings when she was an undergraduate and a committee member in the Law Students International Relations Association, through which she had the opportunity to meet law students from various countries and learn more about their laws and culture.

Samantha Tang

Legal Associate

Samantha Tang trained with the practice before her call and has recently been called to the Singapore Bar. So far, it has been an intense start of a practice for Samantha, involving a variety of areas from corporate transactions, corporate due diligence, legal opinions on a range of subject matter, trade mark proceedings, and estate administration, all intended to leverage Samantha's personal strengths.

Prior to legal practice, Samantha was a research assistant with the Faculty of law, National University of Singapore. Her work here centered on comparative corporate law, with a focus on corporate governance in Singapore, Canada, Australia, the United Kingdom and USA. Samantha continues to be passionate about legal research and has been a valuable contributor to legal writing projects undertaken by the managing partner. Samantha's diverse research interests include German civil law, personality rights, digital currencies, negotiation strategies and behavioural law and economics.

While studying law as an undergraduate, Samantha founded a volunteer organization with a group of like-minded friends, which directed and rolled out a variety of social initiatives in Singapore, including a series of public exhibitions on sustainable development, and an educational programme on project management skills. She also oversaw the development of a sexuality education project for youths-at-risk in Singapore, which earned the support of social organizations such as Action for AIDS and various governmental agencies.

Paul Cruz

Trade Mark Executive

Paul Cruz is the point-man for trade mark prosecution matters in the practice, working closely with the partner-in-charge, trade mark lawyers and trade mark support personnel involved in the different aspects of this practice area, from the formulation and implementation of trade mark filing strategies, to the prosecution, registration, maintenance, watching, searching and protection of trade marks.

Paul takes pride in the team's consistently high rate of success on behalf of clients in the prosecution of trade mark applications, as well as in contentious trade mark proceedings such as opposition, cancellation or invalidation of trade mark registrations, before the Intellectual Property Office of Singapore, all of which he provides invaluable support and assistance on.

Paul is responsible for overseeing a large portfolio of trade mark matters, ensuring that proper docketing of records and follow-on actions are attended to in a timely manner under the well-established protocols and procedures for trade mark matters in the practice. In doing so, Paul is mindful of preserving the efficiencies and reliability in the handling of such matters in the ever-evolving landscape of the IP world, whether on account of interfacing with new systems utilized by IP offices or clients.

Through his exposure to trade mark legal systems in assisting clients with trade mark requirements all over the world, Paul has garnered an impressive working knowledge of a vast array of such legal systems. Alongside, he has also developed a network of strong relationships with trade mark colleagues from numerous countries, which provides an important backbone to the international coverage of the trade mark work undertaken by the practice.

Sandra Ng

Patent Manager

Sandra Ng oversees the overall production line of the sizeable patent prosecution portfolio undertaken by the practice. Sandra has been instrumental in enhancing and optimizing the support infrastructure deployed in this practice area, leveraging intelligent automation along with a robust capability to streamline processes in the handling of voluminous matters, while maintaining flexibility to cater to the unique requirements of individual clients.

Sandra comes with extensive experience in intellectual property that dates back to 1995, particularly in patent prosecution and operation, having worked through the ranks to the management group of one of Singapore's largest patent prosecution firms. There, she had managed a team of 40 dedicated patent personnel and 12,000 patent applications, involving diverse fields of technology including biopharmaceutical, biochemistry, chemistry, semiconductors, etc. in multiple jurisdictions.

As an active proponent of knowledge and data management, Sandra has dedicated herself to the development of internal systems to manage a large client base, with needs across multiple jurisdictions, multiple inventions and recurrent transactions. Her palpable team spirit sees her deftly collaborating with and playing to the strengths of her colleagues involved in patent work, whether in relation to back-office efficiencies, deadline policing, client practices and requirements or substantive advice or actions on the patent matters.
